Welcome to EucalyptH! The terms “we,” “us,” and “our” refer to EucalyptH. We operate this store and website, including all related content, features, tools, products, and services, to provide you (the customer) with a curated shopping experience (the “Services”). EucalyptH is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with our Privacy Policy and Return & Refund Policy, form a legally binding agreement between you and EucalyptH. Please read these Terms carefully, as they include important legal rights and limitations of liability.

By accessing, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm that you are at least the age of majority in your jurisdiction and that you permit any minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including browsing, purchasing, or accessing account features, you may be asked to provide personal information (e.g., billing, shipping, or payment info). You confirm all information is accurate, current, and complete, and that you have the legal right to provide it.

You are solely responsible for maintaining the security of your account credentials and all associated activity. You may not sell, assign, or transfer your account.

We do not warrant that the quality or appearance of any product will meet your expectations or exactly match the images shown.

When you place an order, it constitutes an offer to purchase. Orders are not binding until accepted by EucalyptH. We reserve the right to decline, modify, or cancel any order at our sole discretion.

You will receive confirmation when your order has been accepted and payment processed. We may attempt to notify you using the email, billing address, or phone number provided at checkout.

All purchases are governed by our Return & Refund Policy, which strictly permits returns within 14 calendar days of delivery. Returns requested beyond this window or for non-eligible items will not be accepted.

You warrant that your purchase is for personal or household use only and not for resale.

SECTION 4 – PRICES AND BILLING

All prices are in the currency displayed and are subject to change without notice. Prices do not include taxes, customs duties, import fees, or shipping unless expressly stated.

You agree to provide accurate and up-to-date billing and account information. You confirm that:

  • The payment information you provide is valid,

  • You are authorized to use the payment method,

  • Charges will be honored by your card issuer or bank,

  • You will pay all charges incurred, including taxes and shipping fees.

For international orders, customers are responsible for any customs duties, VAT, or import taxes incurred upon delivery.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, or circumstances beyond our control.

Title and risk of loss pass to you upon transfer of the package to the carrier.

All content and materials on the Services, including trademarks, images, videos, graphics, layouts, product names, and written content, are the intellectual property of EucalyptH, its affiliates, or licensors, and are protected by intellectual property laws. 

You may not copy, reproduce, republish, modify, or distribute any part of the Services without our prior written consent. Unauthorized use is strictly prohibited.

Shopify’s name, logo, and marks belong to Shopify Inc. All other trademarks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” without monitoring or warranty. Your use of any third-party tools is at your own risk, and you are responsible for reviewing and accepting their terms.

New features and tools may be introduced from time to time and will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to third-party sites. We are not responsible for their content, accuracy, policies, or practices.

Accessing third-party websites is at your own risk. Any transactions you make with third parties are solely between you and them.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Although EucalyptH is hosted on Shopify, all sales are made directly with EucalyptH. Shopify is not liable for any loss, damage, or issue arising from your transactions with us.

SECTION 10 – PRIVACY POLICY

All personal data submitted through the Services is governed by our Privacy Policy. Additionally, some data may be shared with Shopify and other third-party service providers. You acknowledge that by using the Services, you consent to such data processing.

SECTION 11 – FEEDBACK

If you submit reviews, suggestions, or any form of content (“Feedback”), you grant us a royalty-free, perpetual, worldwide license to use, reproduce, and publish it for any lawful purpose.

You affirm that:

  • You own the Feedback or have rights to submit it,

  • Your Feedback does not violate third-party rights,

  • You did not receive compensation without disclosure.

We reserve the right to remove or refuse Feedback at our discretion.

You may also be required to submit images (e.g., to prove product defects). These may be retained internally for verification, training, or support purposes.

Failure to enforce any part of these Terms shall not constitute a waiver. These Terms, along with any referenced policies, represent the entire agreement between you and EucalyptH and supersede all prior agreements.

You may not assign these Terms without our written consent. We may assign or delegate our rights without restriction.

SECTION 21 – GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where EucalyptH is headquartered (Australia). Venue shall lie exclusively in the courts of that jurisdiction.

Headings are for reference only and do not affect the interpretation of these Terms.

SECTION 23 – CHANGES TO TERMS OF SERVICE

We reserve the right to update or modify these Terms at any time by posting revisions to our website. Your continued use of the Services after changes are posted constitutes acceptance.
